DP Photography Terms of Service
These Terms of Service (“Terms”) constitute a legally binding agreement made between you (“Client”) and DP Photography (“Photographer”), concerning your access to and use of the photography services provided by DP Photography. By using our services, you agree to be bound by these Terms.
Welcome to DP Photography. By engaging with our services, you agree to the following Terms of Service. Please read them carefully. Your deposit and continued engagement of our services constitute your acceptance of these terms.
1.1 Photography and Videography: DP Photography offers professional photography and videography services. The specifics of the services, including the number of images, video length, and other deliverables, will be detailed in the contract and/or messages between DP Photography and the Client.
2.1 Deposit Requirement: A non-refundable deposit is required to secure your event date and time. The deposit is due upon signing the contract. 2.2 Refund Policy: The deposit is refundable only within 24 hours of being paid. After 24 hours, the deposit becomes non-refundable. 2.3 Remaining Balance: The remaining balance for services is due on the day of delivery of photos/videos. DP Photography reserves the right to withhold all deliverables until the full payment is received. 2.4 Legal Action: In the event that the Client fails to pay the remaining balance by the agreed due date, DP Photography reserves the right to pursue legal action to recover the outstanding amount. The Client will be responsible for any legal fees, costs, and expenses incurred in connection with such action.
3.1 Permits and Permissions: The Client is responsible for obtaining any necessary permits or permissions for the use of the venue or location. 3.2 Cooperation: The Client is responsible for ensuring the cooperation of all parties involved in the event. DP Photography is not liable for missed shots due to lack of cooperation. 3.3 Damages to Equipment: The Client is responsible for any damage to DP Photography’s equipment caused by the Client or anyone associated with the Client. The Client agrees to cover all costs related to repairing or replacing the damaged equipment.
4.1 Ownership: DP Photography retains all copyrights and ownership rights to the images, videos, and any other deliverables produced. 4.2 Usage License: The Client is granted a limited license for personal use of the images and/or videos. The Client may not sell, distribute, or reproduce the images for commercial purposes without the explicit written consent of DP Photography. 4.3 Social Media Use: The Client may share images on social media platforms, provided that credit is given to DP Photography and the images are not altered in a way that misrepresents the Photographer’s work.
5.1 Travel Fees: Travel beyond a [Specify Radius, e.g., 50-mile radius] from [Location] will incur additional travel fees, which will be agreed upon before the event. 5.2 Accommodation: If overnight stays are required, the Client agrees to cover the cost of accommodations for DP Photography, to be arranged and agreed upon in advance.
6.1 Editing Services: Basic editing, including color correction and exposure adjustment, is included in the service. Extensive retouching or special effects may incur additional fees. 6.2 Client Revisions: The Client is entitled to [Specify Number, e.g., two] rounds of revisions. Additional revisions will be billed at an hourly rate of $[Amount].
7.1 Image Storage: DP Photography will store the Client’s images for up to one year after the delivery of the final product. After this period, DP Photography is not responsible for maintaining backups of the Client’s images. 7.2 Raw Files: Raw, unedited files are not included in the deliverables but can be purchased for an additional fee.
8.1 Tagging and Attribution: When sharing images on social media, the Client agrees to credit or tag DP Photography. 8.2 Prohibited Uses: The Client may not alter or filter the images in a way that misrepresents DP Photography’s work. The Client may not use the images for commercial purposes or sell them to third parties without the Photographer’s consent.
9.1 Unforeseen Circumstances: In the event of unforeseen circumstances such as natural disasters or illness that prevent DP Photography from fulfilling their obligations, we will make every effort to find a replacement. If a replacement is not found, DP Photography’s liability is limited to a full refund of all payments received.
10.1 Governing Law: These Terms of Service are governed by the laws of the state in which the services are provided, without regard to its conflict of law principles. 10.2 Jurisdiction and Venue: Any disputes arising out of or relating to these Terms of Service shall be resolved in the courts of the state where the event takes place.
